PixelotechTerms of Service

These Terms of Service ("Terms") govern access to and use of Pixelotech Messaging (the "Service") provided by Pixelotech ("Pixelotech", "we", "us"). By creating an account or using the Service, you ("Customer") agree to these Terms.
1. The Service
Pixelotech provides a business messaging platform built on the WhatsApp Business Platform, enabling Customers to send and receive messages, manage contacts and templates, and collaborate across a team inbox.
2. Eligibility & accounts
- You must be a business and at least 18 years old to use the Service.
- You are responsible for your account, your users, and keeping credentials secure.
- Information you provide must be accurate and kept up to date.
3. WhatsApp / Meta requirements
Use of the Service requires compliance with Meta's and WhatsApp's terms and policies, including the WhatsApp Business Messaging Policy and Commerce Policy. You are responsible for obtaining valid opt-in from your message recipients and for the content you send. Meta may charge you directly for conversations; those charges are between you and Meta.
4. Acceptable use
You agree not to use the Service to send spam or unsolicited messages, unlawful, deceptive, infringing, or harmful content, or to violate any applicable law or third-party rights. We may suspend the Service for violations or platform-integrity risks.
5. Fees
Fees for the Service are as agreed in your plan or order. Unless stated otherwise, fees are exclusive of taxes and are non-refundable. WhatsApp/Meta conversation charges, where applicable, are billed by Meta to your account.
6. Customer data
You retain ownership of your data. You grant us the rights needed to operate the Service. Our handling of personal data is described in the Privacy Policy.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by Pixelotech. These Terms grant no rights except the limited right to use the Service.
8. Availability
We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features with reasonable notice.
9. Disclaimers
The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be error-free or that message delivery via WhatsApp will always succeed.
10. Limitation of liability
To the maximum extent permitted by law, Pixelotech's aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Indemnity
You will indemnify Pixelotech against claims arising from your use of the Service, your content, or your breach of these Terms or of Meta/WhatsApp policies.
12. Termination
Either party may terminate as described in the applicable plan. On termination, your right to use the Service ends and we will delete or return data per the Data Deletion policy.
13. Governing law
These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Vadodara.
